Abstract

The Metaverse unfolds as a hybrid reality, fusing physical presence with digital immersion into a sprawling ecosystem powered by continuous streams of real-time data. Behind its allure lies a sophisticated architecture, a complex web of technologies and platforms that relentlessly captures, analyses, and reshapes vast volumes of personal information. This data proliferation magnifies the stakes of privacy in ways unseen in traditional digital spaces. The Metaverse’s hyper-connected nature exposes users to a novel scale of surveillance and inference, challenging established data protection norms. This study examines these challenges in depth, moving beyond surface-level analysis to explore the intricate ecosystem of data flows that underpin virtual interactions. It proposes a tripartite taxonomy of metaverse data, distinguishing between declared, observed, and inferred data, and offering a framework to identify specific data protection risks. In examining these dynamics, the study considers the divergent governance dynamics inherent in both centralised and decentralised metaverse architectures, recognising that these structural differences profoundly influence privacy challenges and mitigation strategies. This nuanced approach supports the development of targeted, context-sensitive strategies that embed privacy as a foundational element of the Metaverse. Safeguarding data privacy in the Metaverse demands more than technical fixes; it calls for a fundamental rethinking of how privacy is integrated into its very architecture. This study focuses on advancing Data Protection by Design from a theoretical concept to a practical element embedded within the Metaverse Frameworks. Effective privacy protection in this setting requires a coordinated and systematic implementation of technical, organisational, and governance measures across all relevant stakeholders.
