The second joint webinar of DGRI and JIPITEC is dedicated to the transatlantic perspective on the relationship between copyright law and the regulation of Generative AI. The panel will discuss how copyright issues with the input or training stage, the model, and outputs are addressed in Europe and the United States. More specifically, the panel will consider Europe's extensive regulation of GenAI, looking at the interface between the Artificial Intelligence Act (AI Act) and the provisions of the EU Directive on Copyright in the Digital Single Market on text and data mining (TDM).  The panel will explain the AI Act's key copyright obligations, notably regarding TDM opt-outs for rights owners. This will lead to a discussion on the opportunity to establish a mechanism for the fair remuneration of authors and performers. The European situation will be contrasted to the American approach where GenAi is not regulated and copyright issues are currently litigated in court.

The webinar is the second in a loose series of webinars that DGRI will offer together with the open access journal JIPITEC - Journal of Intellectual Property, Information Technology and Electronic Commerce Law - on current issues of IT law from an international perspective. DGRI supports the editorial work of the JIPITEC editors.
